Not necessarily. If it weren't a governor who got caught, it would jail time for her and a $100 fine for him. Usually the john gets away with a chiding while the pro goes to jail. But he's a governor, so it's a circus and public flogging.

Make it more complex. A majority of prostitutes are drug addicts used as simple currency by drug dealers/pimps, who keep them addicted and control them as virtual slaves, then vanish when they get picked up. Therefore, sometimes an arrest is the best thing to happen to her - her one chance to get help. Instead, she gets to detox (or not) in jail, and gets thrown back out on the street jonesing. Not that we see this every month on the court docket or anything... Yeah, sometimes life is easier in fiction. :)

See, the fact that nobody in the news media can just come out and SAY, in their out loud voice, is that the high-priced hooker deal isn't really THAT bad, for either party. I mean, it's not helping child cancer patients enjoy their last days, but it's not that bad, either. It's more the moral equivalent of indulging in a cheeseburger, except on a higher plateau. If he'd been some anonymous corporate lawyer, nobody would give a shit.

The reason it's bad for Elliot is because:

1. If you're the Governor, one expects that you would take special care to observe the laws as they exist on the books, even if they're stupid laws. It demonstrates reckless, arrogant judgment not to. Whereas, on the part of an anonymous corporate lawyer, it just demonstrates being horny.
2. Being that Elliot was himself the sponsor of legislation that put harsher penalties on johns, the hypocrisy is astounding. People will put up with/forgive a lot of stuff in America, but hypocrisy, lying, and betrayal will kill you every time.

In most states it's the hooker not the john that is punished, but I was listening to CNN the other day and they said Spitzer himself passed some law to change that in New York.

Of course this all came out in some federal investigation and it sounds like the feds are not interested in going after the girl (not sure they even can). Thy are more interested in the money trail.

What kind of jail time do you think she should get? Should she be punished more for fucking somebody important? Usually they just get time served, which is like an overnight stay.
